These Terms of Service govern your use of the SupaDrone service operated by supadrone.com ("SupaDrone", "we", "us").
By requesting a mission, purchasing a pod, licensing capture or otherwise using the service, you agree to these terms.
1. What the service is
SupaDrone provides aerial inspection, survey and capture services flown from permanently deployed drone infrastructure at registered sites.
You do not operate the aircraft. You request an outcome. SupaDrone plans and validates the mission, a qualified operator supervises the flight, and the captured data is processed and delivered to you. You are not the operator of the aircraft, you are not required to hold any aviation qualification, and you are not the party responsible for the conduct of the flight.
SupaDrone obtains and holds the regulatory and airspace approvals required for each site at which it operates.
2. Accounts
You must provide accurate account information and keep it current. You are responsible for activity carried out under your account and for the security of your credentials. Accounts may be held by an individual or by an organisation. Where an organisation holds the account, the individual accepting these terms warrants that they are authorised to bind that organisation.
3. Missions
3.1 Requests
A mission request identifies a registered site, an asset at that site, a mission type and a timing preference. Submitting a request is an offer to purchase a mission at the applicable price.
3.2 Validation
Every request is validated before it flies against pod and aircraft availability, site operating constraints, weather within the flight window, equipment health and the requirements of the mission type.
A request may be accepted, held pending suitable conditions, or declined as outside what the site is approved or equipped for. Holding a mission for weather or operating conditions is a normal outcome and is not a breach of these terms.
3.3 No guaranteed flight window
Except where a written service level has been separately agreed, SupaDrone does not guarantee that a mission will fly within any particular period. Flights are subject to weather, airspace conditions, equipment health and the operating envelope approved for the site.
3.4 Recurring missions
Where you set a recurring schedule, each occurrence is validated independently. An occurrence that cannot fly may be delayed or skipped without affecting the remainder of the series. Charges for skipped occurrences are set out in section 6.
3.5 Reflights
Where capture fails to achieve what the mission was requested to achieve, SupaDrone will reflight rather than deliver short capture, at no additional charge to you.
4. Your obligations regarding sites
Where you request a mission at a site you own or control, you warrant that:
- you have the authority to authorise aerial operation and capture at that location;
- you have informed persons routinely present at the site, including employees, contractors and visitors, that aerial inspection takes place there; and
- you will not request capture whose purpose is the observation of identified individuals.
You must not use the service for surveillance of individuals, for harassment, or for any purpose that is unlawful in the jurisdiction where the site is located.
SupaDrone may decline or cancel any request that in its reasonable judgement falls outside these obligations, or that would exceed the operating envelope approved for a site.
5. Pod ownership (Hosts)
5.1 Purchase
A Host purchases the pod outright. Title in the hardware passes to the Host on payment in full. Deployment is subject to the site meeting technical and regulatory requirements, and to regulatory approval being obtained for the location.
5.2 What remains with SupaDrone
Ownership of the hardware does not transfer operation of it. SupaDrone continues to hold the regulatory and airspace approvals, to supervise missions through qualified operators, and to provide SkyyOS. A Host requests missions from their own pod in the same manner as any other customer.
5.3 Approval timelines
Regulatory approval for a location is obtained before deployment and typically takes a period measured in months. Timelines communicated before approval is granted are estimates and are not warranties.
5.4 Sharing is optional
A Host may elect to make their pod available to third-party demand when it is not in use. This election is optional, may be withdrawn, and is not a condition of purchase. Where sharing is enabled, SupaDrone pays the Host a fee for each third-party mission flown from the pod, at the rates and on the payout schedule set out in the Host agreement.
The missions of the Host take precedence over third-party demand.
5.5 Third-party missions
A third party flying from a pod owned by a Host receives the data from their own mission only. They obtain no rights to the missions, data or site records of the Host, and the Host obtains no rights to theirs.
6. Fees and payment
Fees for missions, pods and licences are as quoted at the point of purchase. Unless stated otherwise, fees are exclusive of applicable taxes, which are charged in addition.
Mission fees are payable per mission or on the schedule agreed for a recurring series. Where an occurrence in a recurring series does not fly, that occurrence is not charged.
Where the service maintains a balance on your account, funds credited to it are applied to missions and licences as they are incurred. Balances are not deposits, do not accrue interest, and are refundable only as required by law or as separately agreed in writing.
Late payment may result in suspension of missions, including occurrences of a recurring series.
7. Data and rights
7.1 Your data
Capture delivered to you in fulfilment of a mission you commissioned, together with the results derived from it and the associated mission record, belongs to you.
7.2 Licence you grant to SupaDrone
You grant SupaDrone a non-exclusive licence to host, process, quality check, store, transmit and deliver your capture, to the extent necessary to provide the service. This licence does not permit SupaDrone to license your capture to third parties except under section 7.4.
7.3 The operational record
SupaDrone retains the operational record of each flight, including what was requested, when it flew, the conditions and approvals under which it flew, and who supervised it. This record is retained independently of your account and of any deletion request, because SupaDrone remains accountable for flights it has conducted.
7.4 SupaVault listing is opt-in
Capture is listed for licence in SupaVault only where the site owner has explicitly opted in. Imagery of a site whose owner has not opted in is never listed. An opted-in site owner receives a share of what listings of their site sell for, at the rates set out in their agreement.
Opting in may be withdrawn. Withdrawal stops the listing being offered thereafter and does not terminate licences already granted, which continue on their existing terms.
Listings are of places. Capture whose subject is a person is not listed.
7.5 Licensing from SupaVault
Where you license capture from SupaVault, the scope of permitted use, the territory and the duration are as stated for that listing. You may not sublicense or redistribute licensed capture except as expressly permitted by that listing.
8. Safety and operational limits
SkyyOS coordinates and monitors operations. It does not replace the aircraft autopilot or vendor flight-safety systems, and flight-critical control and aircraft recovery remain within the supported aircraft and dock systems.
The service is not autonomous, does not operate outside the envelope approved for a given site, and does not guarantee availability at any given moment. Search and rescue support is provided as responder support under qualified supervision, and nothing in these terms constitutes a warranty of emergency response capability.
9. Suspension and termination
You may terminate your account at any time. Termination does not entitle you to a refund of fees for missions already flown, and does not affect licences already granted under section 7.
SupaDrone may suspend or terminate the service where you materially breach these terms, where payment is overdue, or where continued operation at a site would be unlawful or unsafe. Where the regulatory approval for a site is withdrawn or lapses, missions at that site cease until approval is restored.
10. Warranties and liability
The service is provided with reasonable skill and care. Except as expressly stated, SupaDrone gives no warranties, and in particular does not warrant that any mission will fly within a particular window or that capture will reveal any particular condition.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.
Subject to the preceding paragraph, SupaDrone is not liable for indirect or consequential loss, loss of profit, loss of contract or loss of anticipated savings, and its total aggregate liability arising in connection with the service is limited to the fees paid by you in the twelve months preceding the event giving rise to the claim.
Delivered capture is information, not a professional certification. Decisions about structural condition, safety, compliance or valuation remain yours and should be taken with appropriately qualified advice.
11. Changes to these terms
SupaDrone may amend these terms. Where an amendment is material, notice will be given before it takes effect. Continued use of the service after the effective date constitutes acceptance.
